Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services.
Section 1 — Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or place of residence, or that you have given consent for any minor dependents to use this site.
You may not use our products, website, or services for any illegal or unauthorized purpose. You may not violate any applicable laws, including but not limited to intellectual property laws, consumer protection laws, fraud laws, and payment processing rules.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, reverse engineer, or misuse any portion of the Service, website, product content, images, descriptions, branding, or access to the Service without express written permission from Rose in Concrete.
Headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.
Section 3 — Accuracy, Completeness & Timeliness of Information
We make reasonable efforts to provide accurate product information, pricing, descriptions, images, policies, and availability. However, information on this site may contain errors, inaccuracies, omissions, or outdated details.
Product colors, sizing, measurements, materials, availability, packaging, and appearance may vary due to supplier updates, photography, lighting, screen settings, manufacturing variations, or fulfillment source.
We reserve the right to correct errors, update information, change product details, or cancel orders affected by errors, inaccuracies, omissions, inventory issues, supplier changes, or pricing mistakes.
Nothing in this section limits any rights a customer may have under applicable law.
Section 4 — Modifications to Service & Prices
Prices for products are subject to change without notice.
We reserve the right to modify, suspend, discontinue, or limit any product, service, offer, promotion, discount, website feature, or availability at any time without notice.
We are not liable to you or any third party for modifications, price changes, suspensions, or discontinuations of the Service, except where required by applicable law.
Section 5 — Products & Services
Certain products may be available exclusively online through the website. Products may have limited quantities and may be subject to our Return, Refund & Cancellation Policy and Shipping & Delivery Policy.
Rose in Concrete works with third-party suppliers, dropshipping suppliers, fulfillment partners, domestic warehouses, and international warehouses. Some products may be made-to-order, limited-availability, supplier-fulfilled, specialty, or designer-inspired items.
We make every reasonable effort to display product images, colors, sizing, and descriptions accurately. However, we cannot guarantee that your device’s display will accurately reflect product color, scale, texture, fit, or detail.
We reserve the right to limit sales of products or services to any person, geographic region, jurisdiction, account, payment method, or order where permitted by law. We may exercise this right on a case-by-case basis.
We reserve the right to limit quantities, discontinue products, refuse orders, or cancel orders where permitted by law.
Section 6 — Designer-Inspired Products Disclaimer
Rose in Concrete may sell designer-inspired products.
Rose in Concrete is not affiliated with, endorsed by, sponsored by, licensed by, or associated with any designer brand unless expressly stated.
All trademarks, logos, trade names, brand names, and intellectual property belong to their respective owners.
Any reference to designer style, inspiration, aesthetic, or look is for descriptive purposes only and does not represent authenticity, affiliation, endorsement, sponsorship, licensing, or association.
Purchasing a designer-inspired item confirms that the customer understands the item is not represented as an authentic designer product unless expressly stated in the product description.
No refund, return, cancellation, or exchange will be issued due to misunderstanding, assumption, or dissatisfaction related to brand affiliation, authenticity, or designer comparison where the product was accurately described before purchase.
Section 7 — Billing, Payment & Account Information
We reserve the right to refuse, cancel, hold, or review any order where we suspect fraud, payment risk, abuse, chargeback abuse, policy violations, inaccurate information, inventory issues, supplier issues, or unauthorized activity.
You agree to provide current, complete, and accurate purchase, billing, shipping, contact, and account information for all purchases made through our store.
Customers are responsible for ensuring that all billing information, shipping information, email addresses, phone numbers, product selections, sizes, colors, and quantities are accurate before submitting an order.
Orders placed with incorrect, incomplete, or inaccurate details are the customer’s responsibility.
You agree to promptly update your account, billing, shipping, and contact information so we can complete transactions and contact you as needed.
Section 8 — Orders, Cancellations, Returns & Refunds
All purchases are subject to our Return, Refund & Cancellation Policy, which is incorporated into these Terms by reference.
By placing an order, you acknowledge and agree that:
- Orders begin processing immediately after checkout.
- All sales are final unless otherwise required by law or approved by Rose in Concrete in writing.
- Returns, refunds, exchanges, and cancellations are not guaranteed.
- Cancellation requests are reviewed case-by-case and may be denied.
- If cancellation is exceptionally approved, any refund may be reduced by non-recoverable costs already incurred in connection with the sale, including but not limited to advertising fees, payment processing fees, supplier charges, fulfillment costs, handling costs, transaction fees, or administrative costs.
Nothing in these Terms limits any rights a customer may have under applicable law.
Section 9 — Shipping, Delivery & Fulfillment
All shipping, processing, tracking, and delivery terms are governed by our Shipping & Delivery Policy, which is incorporated into these Terms by reference.
Rose in Concrete may fulfill orders through third-party suppliers, dropshipping partners, fulfillment centers, domestic warehouses, and international warehouses.
Processing time, tracking assignment, carrier pickup, carrier scans, and delivery time are separate stages of fulfillment.
Delivery dates and transit times are estimates only unless expressly guaranteed in writing.
Rose in Concrete is not responsible for carrier delays, customs delays, weather delays, high-volume season delays, supplier routing delays, incorrect customer shipping information, or events outside our reasonable control.
If Rose in Concrete is unable to ship an order within the stated processing/handling timeframe or any separately promised shipment timeframe, we may issue a delay notice, request customer consent to continue processing, or cancel and refund the unshipped order where required by applicable law.
Section 10 — Chargebacks, Payment Disputes & Fraud Prevention
Customers agree to contact Rose in Concrete at support@shoproseinconcrete.com before filing a chargeback, payment dispute, or claim with their financial institution so that we have an opportunity to review and resolve the issue.
Rose in Concrete actively responds to chargebacks, payment disputes, fraud claims, and payment abuse with supporting documentation, which may include order confirmations, checkout records, payment records, policy agreement records, customer communication, tracking information, delivery confirmation, IP address or device information where available, supplier records, fulfillment records, and any other relevant evidence.
Filing false, abusive, or misleading disputes may result in cancellation of pending orders, refusal of service, denial of future purchases, account restriction, and pursuit of available remedies where permitted by law.
Nothing in these Terms limits any rights a customer may have under applicable law.
Section 11 — Optional Tools
We may provide access to third-party tools that we do not monitor, control, or manage.
You acknowledge and agree that access to such tools is provided “as is” and “as available,” without warranties, representations, or conditions of any kind.
Use of optional third-party tools is entirely at your own risk and discretion. You should review and approve the terms provided by the relevant third-party provider.
Section 12 — Third-Party Links
Certain content, products, services, or links available through our website may include materials from third parties.
Third-party links may direct you to websites that are not affiliated with Rose in Concrete. We are not responsible for examining or evaluating the content, accuracy, policies, products, services, or practices of third-party websites.
We are not liable for harm, damages, losses, or issues related to third-party websites, tools, products, or services.
Please review third-party policies carefully before engaging in any transaction.

You agree that your submissions will not violate any third-party rights, including copyright, trademark, privacy, personality, or other personal or proprietary rights.
You agree not to submit unlawful, abusive, defamatory, obscene, misleading, fraudulent, malicious, or infringing content.
We may monitor, edit, refuse, or remove content that we determine to be unlawful, offensive, threatening, defamatory, obscene, harmful, misleading, infringing, or otherwise objectionable.

To the fullest extent permitted by law, Rose in Concrete disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee that your use of the Service will be uninterrupted, timely, secure, error-free, or free from defects.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
